We may terminate user’s registered account, at our sole discretion, by emailing the user at the email- address or sending text message at the mobile number (used for registration) stating that the agreement has terminated.
In no event the company, its affiliates and/or licensors be liable for loss of Profits, special, incidental or consequential damages resulting from possession, Access, use or malfunction of this website, including but not limited to, damages To property, loss of goodwill, device failure or malfunction and, to the extent Permitted by law, damages, property damages or punitive damages from any Causes of action arising out of or related to use of this website and this t&c, Whether arising in tort (including negligence), contract, strict liability or Otherwise and whether or not the company, its affiliates and/or its licensors Have been advised of the possibility of such damages. In no event shall the Company’s, its affiliates’ and/or its licensors’ liability for all damages (except as Required by applicable law) exceed an amount of inr 10,000/- (indian national Rupees ten thousand only). These limitations of liability shall not be applicable Solely to the extent that any specific provision of this limitation of liability is Prohibited by any federal, state, or municipal law, which cannot be pre-empted. This t&c gives you specific legal rights, and you may have other rights that vary From jurisdiction to jurisdiction.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this T&C that is caused by any act or event beyond our reasonable control, including failure of public or private telecommunications networks (“Event Outside Our Control”). If an Event Outside Our Control takes place that affects the performance of our obligations under this T&C: (a) our obligations under this T&C shall be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control; and (b) we will use our reasonable endeavours to find a solution by which our obligations under this T&C may be performed despite the Event Outside Our Control.
These T&C are governed by the Indian laws, without respect to its conflict of laws principles. The courts at Delhi shall have the exclusive jurisdiction in respect of any and all legal dispute or matter arising out of user’s use and access of the Website. The parties expressly agree that in case any dispute arising out of services rendered, access or use of the Website or content they shall make all attempts to resolve it by amicable settlement and discussion failing which, by arbitration as per the provisions of Arbitration and Conciliation Act, 1996. Such Arbitration shall be by a Sole Arbitrator appointed by us. The Arbitration proceeding shall be conducted in Delhi, in English language. The Arbitrator shall pass a reasoned award in writing, which shall be final and binding upon the parties.
Please keep in mind that mere reporting to the Company does not guarantee that certain content will be removed from the Website, however, we are committed to creating a safe environment and will consider all user’s genuine grievances/ complaints.
Subject to applicable laws, the English language version of this T&C shall prevail over any other language version issued by us for user’s benefit.
These T&C shall constitute the entire agreement between the parties and supersedes all other terms and conditions and/or agreements relating to the subject matter, and set out the complete legal relationship between Company and any other party arising from or connected with the subject matter. For the avoidance of doubt, in the case of any conflict between these T&C, and any other agreement, these T&C shall apply.
If any part of these T&C is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the T&C shall continue in effect.
Any and all notices, statements or other communication relating to any disputes, grievances experienced by the user shall be given or made in writing in the English language and delivered by electronic mail or sent by prepaid post with recorded delivery addressed to us at the following address: firstname.lastname@example.org .
